Alina Habba has stepped down as the US Attorney for New Jersey. This comes after a legal ruling that invalidated her eligibility to serve.
Attorney General's Statement
The head of the Justice Department, Pam Bondi, confirmed her stepping down on the start of the week. Bondi stated that the judicial decision made it "untenable" for the official to effectively run her office.
"Do not interpret adherence to the ruling as defeat," Habba stated. "The effort will now reach across the country."
Court Ruling
Habba's exit comes a week after a US appeals court found that she had been serving in violation of the law as US attorney. This ruling is could influence scores of legal proceedings in the state.
The court said that a acting appointment that did not receive Senate approval violated the statute on vacant positions.
Future Role and Reaction
The Attorney General added that Habba will stay on at the Department of Justice as a senior adviser. Habba plans to challenge the decision of the court's action, with hopes of a reversal.
In a statement, she argued that the court "must not override the executive's selection of attorneys responsible for carrying out the primary duty of the administration of criminal prosecution."
Record and Legacy
She highlighted the prosecutor's work and pointed out that under her leadership, the state capital of Newark saw a 20% reduction in crime. She also stated that the southern city of Camden experienced its initial homicide-free summer since 1974 free from homicides.
Background and Previous Role
Habba, 41, first joined Trump's personal legal team in recent years. She later represented her client in his business records case in the previous year, leading to his conviction on multiple felony counts of document fraud.
Prior to Habba took on the federal prosecutor position, Trump had announced he was selecting her as his presidential counsellor during his second administration, labeling the lawyer as deeply loyal and a "tireless advocate for justice".
